How does the Seller Disclosure Statement process work at Ownit?

Once you engage us and return your signed Authority & Terms of Engagement, along with your completed Disclosure Statement Checklist (inc supporting documents) and payment for search outlays, we’ll get started.
We prepare your Form 2 Disclosure Statement and compile all relevant supporting documents. Once completed, we deliver the disclosure documents to both you and your real estate agent so they can be provided to prospective buyers before a contract is signed.

What property searches are required for Disclosure?
Disclosure requirements vary depending on your property type and any known notices or restrictions. If you’ve marked “Yes” on your checklist for any relevant matters, you are responsible for providing the related documents. Ownit will then order standard searches to support your Disclosure Statement. These may include:

What documents must be included in the Disclosure Statement?
Under Queensland’s Property Law Act 2023, sellers must disclose:
• A copy of any mandatory notices, orders, or applications under relevant legislation
• Complying notices for owner‑builder work from the past six years (if applicable)
• A CMS (Community Management Statement) and Body Corporate certificate, if relevant

Does a Seller Disclosure Statement expire?
While there is no formal expiry date, the Disclosure Statement must be true and accurate at the time it is given to the buyer.
If circumstances change (e.g. updated body corporate levies or a new Council notice), you must notify us and request an updated statement. Failing to provide accurate and current disclosure can give the buyer rights to terminate the contract up until settlement.

Can my real estate agent prepare the Disclosure Statement?
No. Real estate agents are not authorised to provide legal advice or prepare disclosure documents unless they are legally qualified.
